UPP (Broadgate Park) Limited (UPP) is committed to protecting the privacy of students applying for accommodation at Albion House, Broadgate Park and Cloister House, its residents, the users of its website www.uppbroadgatepark.com, and anyone we communicate with. It is our goal to maintain compliance with the highest standards of privacy so that users of our website, students receiving our services, and anyone we communicate with, be informed about their privacy rights and how the law protects them so that they may comfortably and safely deal with us for a range of information needs. UPP operates the Broadgate Park accommodation at the University of Nottingham. We use your personal data, as set out in the policy, which includes:

1. Aim of this policy

UPP processes personal data in compliance with data protection legislation.  This policy relates to how UPP processes personal data relating to individuals which apply for or use our accommodation services at Broadgate Park, access our website, provide information to us via our website, via our social media accounts and communications between us. If you provide information about others, like your family members or guests, then this policy applies to any individuals whose personal data you provide to us.

Our services, and our website, are not intended for children and we do not collect personal data relating to children unless we are providing accommodation to your children.

2. Who is in charge of the data collected?

UPP is responsible for processing your data. and will deal with your enquiries if you communicate with us. Where appropriate, we may ask one of our UPP group companies to deal with your request. Usually, this will be UPP Residential Services Limited, or it may be our parent company, UPP Group Limited who provide services to us.

UPP will treat your personal data (which means data from which you can be identified, including – but not limited to – your name, address, e- mail address, phone number, room number, details of your application and your residence agreement with us, as well as technical information about your visit to our website, and the like) in accordance with  data protection legislation here in the UK.

It is important that the personal data we hold is accurate and up to date. Please inform us if any of your personal data changes during your relationship with us.

6. What information do we collect about you?

When you contact us through the UPP website, our social media accounts, or communicate with us, or use our accommodation, you will provide us with personal data about you, such as:

  1. Identity data includes first name, last name and title.
  2. Contact data includes email address and telephone numbers, your social media profile information (if you use this to get in touch with us) and the content of your communications with us by whatever means.
  3. Application data includes your application for accommodation, our discussions with you, our decision about your application, as well as other information you, the University, UCAS, or any others provide in support of your application. This may include information about any special requirements you provide to us, such as easy access rooms, or facilities for any health or disability issues you may have.
  4. Resident data includes your student residence agreement with us, details about your use of our accommodation including your room number, access details (like your key number, or security card, and where and when they are used), your communications with us as a resident, details of your family members and your guests who use the accommodation, details about your deposit, and communications with us from others about you or your use of the accommodation (like maintenance or cleaning, or complaints from other residents), and historic addresses and forwarding addresses and contact details. This will include information about any special requirements you have, whether you or the University provides those to us, or we make an assessment about you, such as your requirements for easy access rooms, or facilities for any health or disability issues you may have, or where we need to make decisions about your safety and safety of others.
  5. Financial data includes the details you provide to pay for your accommodation or arrange a refund, including bank account and payment card details. This may also include your intended method of payment and reliance upon your student loan to meet your payment arrangements.
  6. Marketing and communications data includes your preferences in receiving marketing from us, and your communication preferences.
  7. Technical data includes Internet protocol (IP) address; [your login data;] browser type and version; time zone setting and location; browser plug-in types and versions; operating system, platform and other technology on the devices you use to access our website; information about your visit, including the full Uniform Resource Locator (“URL”); clickstream to, through and from our website or the social media accounts that we operate (including date and time); information that you viewed or searched for; page interaction information (such as scrolling, clicks, mouse-overs and likes); and any phone number used to call our customer service/receptionist office number.
  8. Usage data includes information about how you use our website, such as time of visit, pages viewed, and time spent on these pages. Aggregated data is collected and reviewed to understand website usage, the data is not used to track individual activity.
  9. CCTV includes the images recorded by the CCTV system used at and around the accommodation at Broadgate Park

7. How is personal data collected by UPP?

We use different methods to collect data from and about you including through:

  • Direct interactions with you. You may give us your identity data, contact data, applicant data, resident data, and marketing and communications data by filling in forms or by corresponding with us via our website, by post, by phone, by email, via our social media accounts, face to face or otherwise, or respond to a survey or enter a prize-draw.
  • Third parties or publicly available sources. We may receive personal data about you from various third parties and public sources:
  • Applicant data – where we receive information from others such as the University, or UCAS about your application for accommodation.
  • Resident data – where we receive information from the University about your attendance or any welfare issues we need to be aware, or from police.
  • Marketing and communications data. When we use social media sites such as Instagram, Facebook and Twitter to contact you via that platform or share content with you. Those sites may also provide us with information about you, such as where you send us a message, or like or comment on us or our content. We do not buy in mailing lists.
  • Technical data. You may provide this to our hosting providers when you interact with our website or our social media accounts. We also receive information from the following parties:

  • Identity and contact data from the police and HM Revenue & Customs (“HMRC”).

Purposes and legal bases for processing your personal data

Data protection law requires that UPP needs to have a lawful basis to process personal data.

Generally, we do not rely on consent as a legal basis for processing your personal data other than in very limited circumstances, for example, in relation to sending direct marketing communications to you via email or text message or where we process special categories of personal data about you.

Where we need to collect personal data by law, or under a contract we have with you, or we are processing your personal data to fulfil a request you have made, and you fail to provide that data when requested, you may be in breach of the law, and/or we may not be able to perform the contract or comply with your request. 10. Who do we share your information with?

All of our contractors, suppliers and staff (including volunteers, agents, temporary workers and casual workers) are subject to strict contractual requirements and are aware of their data protection obligations when   processing personal data on our behalf.

Where we are required to disclose your personal data to another organisation that acts as a controller (for example, the University, law enforcement agencies; regulators; HMRC; or as part of court proceedings), we will only do so if required by law, or where appropriate, you have approved that disclosure.

We only disclose information to a third party where permitted by law, where they are acting as our data processors under a contract, or where it is necessary to achieve a legitimate purpose. We will never share your personal data with any party for their own marketing purposes without your prior consent.

We may disclose your personal data to the following:

  • Internal third parties such as our subsidiary companies. This includes UPP Residential Services Limited (which is our main accommodation provider subsidiary), UPP Group Limited which provides central group services such as our IT and management services, as well as any of our subsidiaries and parent companies which support our services or have a need to know in order to respond to your enquiries or to meet our commitments to you.
  • External third parties in connection with our services – this includes:
    • The University of Nottingham where we need to verify your attendance at the University, and where they need information to support your attendance at the University, or to help support the health and safety and security of you and others while attending the University or using its facilities.
    • Our suppliers, sub-contractors and providers of goods or services for the performance of any contract that we enter into with them to support our business. For example, our sub-contractors in technical, payment and delivery services, marketing and advertising service providers, analytics providers, and search and social media information and optimisation providers.
    • Where legally compelled to do so, a court or tribunal, a regulatory authority, and law enforcement agencies.
    • Other professional advisers acting on your behalf.
    • Our professional advisers and our bank.
    • Our insurers if we need to discuss your organisation’s request for services.
    • Companies in the event that we sell or buy any business or assets, in which case we will disclose your personal data to the prospective seller or buyer of such business or assets only for that purpose and subject to appropriate confidentiality agreements.
    • Companies who acquire UPP assets in whole or in part, the personal data held by it about its customers will be one of the transferred assets.
    • To enforce or apply our website’s Terms of Use or our standard terms and conditions of business or other agreements, or to protect the rights, property or safety of UPP, our residents, other students, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.
  • To anyone where we have you prior consent.

11. Security procedures/access.

The only people who can use your personal data are authorised UPP staff, in particular our ICT department, or our suppliers which are contractually committed to maintain the confidentiality of your personal data and to treat it in accordance with data protection law in the UK.

UPP has a strong commitment to data security. UPP uses all reasonable endeavours to protect personal information from loss, misuse or alteration and we have put in place physical, electronic, and managerial procedures to safeguard and secure the information you provide to us. UPP takes appropriate steps to communicate and train its staff in relation to applicable data protection law.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our website or via the social media accounts that we operate; therefore, any transmission is at your own risk.

12. International Data transfers

Wherever possible, we will not transfer your data outside the European Economic Area (EEA). However, there are circumstances where this will be unavoidable. Whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

How long will your personal data be retained for?

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting or reporting requirements.

14. Automated decision-making including profiling

UPP does not use your personal data to make any automated decisions or conduct any profiling about you.

You have the following rights under data protection law:

  • The right of access:  You have the right to request access to your personal data (known as a “data subject access request”). You can ask to receive a copy of the personal data we hold about you.  It helps you understand how and why we are using your data, and to check that we are lawfully processing it.
  • The right to rectification: You have the right to request to correct any of your personal data which you think is inaccurate or incomplete.
  • The right to erasure:  You have the right to request your personal data to be deleted (also known as ‘the right to be forgotten’).
  • The right to restrict processing :  You have the right to  ask us to suspend processing of your personal data if: (a) you are concerned about the accuracy of the personal data; (b) where processing of your personal data is unlawful but you do not want it to be erased but restricted instead; (c) you need it to establish, exercise or defend legal claims even though we no longer need it; or (d) you have objected to the use of your personal data but we need to verify whether we have overriding legitimate grounds to use it.
  • The right to object:  You have the right to object to the processing of your personal data in certain circumstances such as where we are processing your personal data for direct marketing purposes, including any profiling related to that direct marketing.
  • The right to data portability:  You have the right to request the transfer of your personal data to a third party where your information is processed by automated means, and we process your personal data on the basis of consent or a contract with you, you can ask to be provided with your personal data, or that a third party you have chosen is provided with, your personal data in a structured, commonly used, machine-readable format.

No fee is usually required – You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive to meet the administrative costs of complying with the request, or if you are requesting further copies of your data following your subject access request.

What we may need from you 

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond 

We try to respond to all requests promptly but usually within one month of receipt. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. If this is the case, we will notify you and keep you updated.
